Abstract
Divorce results in the breaking of zahir and inner ties between husband and wifeand will cause various problems, including child custody. Parenting in Islamiclaw is a priority that falls to a mother who is most entitled to take care of her until the child reaches the age of tamyiz. It is dif erent in the Tapanuli ethnicity in Panti District, Pasaman Regency, after the divorce between husband and wife, thecustody of the child falls to the father. The purpose of this discussion is to analyzethe implementation of child custody in the Tapanuli ethnic group accordingtoIslamic law. This research is a type of qualitative research using a normativejuridical approach, where the author conducts interviews, observations anddocumentation studies on aspects or targets of the research subject. In theauthor's findings, the implementation of child custody in the Panti District, Pasaman Regency falls to the father, because according to Tapanuli the childdoes not belong to the mother but belongs to the father, the authority to take careof children after a divorce occurs where the child is fully cared for by the father not the mother, because Boys are the main priority in achieving children. Meanwhile, in the study of Islamic law, custody of children who fall to the father before the child reaches the age of tamyiz is not in accordance with Islamicguidance
